Lynberg & Watkins attorneys Catherine Naltsas and Ryane Skinner secured an early win for their natural toothpaste client defending a potential class action lawsuit in the Northern District of California. Plaintiffs alleged that the natural toothpaste product contained PFAS. Pre-suit, it was determined through proven scientific testing and expert analysis that the tube toothpaste product contained no PFAS. Lynberg & Watkins took an aggressive litigation posture challenging the validity of Plaintiff’s claims through an early pre-trial motion. Ryane Skinner and Catherine Naltsas argued before the Honorable Noël Wise further enforcing that Plaintiff cannot show any evidence that the company ever knew or suspected PFAS contamination in its toothpaste products. The Court agreed with the Lynberg & Watkins team. This resulted in a dismissal with leave to amend; however, all claims entitling plaintiff to punitive damages and attorneys fees were not subject to amendment. This was a great result and monumental defense cost saving for the client.
