Congratulations to Lynberg & Watkins attorneys Catherine Naltsas and Lisa M. Hiraide on their latest success! Over three years of litigation has ended with a total defense win—Summary Judgment GRANTED for all three religious entity clients who were sued in 2020 under the California revival statute CCP 340.1 for alleged negligence giving rise to sexual abuse allegations from the early 1980s. The Court found that because (1) no Defendant employed the alleged perpetrator during the period of abuse, (2) the alleged perpetrator was not an agent of any Defendant, and (3) Plaintiff was not enrolled in any church-sponsored youth activity at the time of the abuse or ever, no special relationship could be found to establish a duty owed by any Defendant to Plaintiff.
