Michael Larin (Partner, Los Angeles) and Andrew Higgs (Partner, Orange County) obtained summary judgment in a high-exposure products liability matter on behalf of Lynberg & Watkins’ client, an electric motorcycle manufacturer. The plaintiff, an automotive mechanic, alleges he sustained significant injuries due to purported “unintended acceleration” of the motorcycle, causing the motorcycle to fall and drag him at high speeds during a test drive. Larin and Higgs argued that the plaintiff presented no evidence establishing that our client placed the motorcycle into the marketplace in a defective condition, or that our client failed to adequately warn of the hazards associated with the use of the motorcycle. The court agreed, granting summary judgment in favor of our client as to the entirety of plaintiff’s Complaint and all causes of action asserted (which included causes of action for strict liability based on manufacturing, design and warning defect, negligence, and breach of warranty).
