Lynberg & Watkins attorneys Catherine Naltsas and Tamara Heathcote obtained an early dismissal with prejudice of a consumer products class action involving a natural toothpaste company. Plaintiffs alleged that the toothpaste was contaminated with PFAS. We battled this case consistently on getting to the truth underlying the science supporting the Complaint. All our discovery was aimed at challenging the flawed testing performed for PFAS in the natural toothpaste. We obtained significant testimony from Plaintiffs’ testing facility that the science presented by Plaintiffs was non-defensible, and in fact no PFAS was present or detectable in the product. This resulted in an immediate dismissal of the matter, avoiding the cost of Certification of the Class and Summary Judgment.
