Catherine Naltsas obtained a successful dismissal of an action for want of personal jurisdiction under FRCP 12(b) 2. The matter involved a lawsuit filed against an international hotel chain headquartered in the United Arab Emirates, for alleged bodily injury which occurred abroad. Plaintiff sought to file this matter in a jurisdiction such as California, which is known for higher verdicts and settlements, as opposed to where jurisdiction would have been proper. Originally filed in state court in California, the case was removed and Catherine moved for an immediate Motion to Dismiss. Upon filing the briefing, the matter was voluntarily dismissed by Plaintiff, which saved our client the expense of litigating this matter in California.
