On a consumer products class action case involving a natural brand toothpaste product in the Northern District of California, Catherine Naltsas successfully obtained a dismissal with prejudice and attorney fees.
The dismissal came following multiple successful Motions to Dismiss for which plaintiff was given leave to amend. Finally, the matter was disposed of in its entirety at which point Catherine moved for an attorney fee award under the Court’s inherent authority to award fees as sanctions for bad faith, frivolous, and vexatious litigation.
The Court indicated that she was inclined to award attorneys fees in favor of defendant and the parties reached a negotiated resolution on the fee amount.
The client was pleased not only to have the matter resolved pre-discovery through aggressive motion practice, but also to recover fees incurred.
