Shareholder Lane E. Webb and Partner Shanna Van Wagner achieved a defense verdict on a 10-day tenant habitability case alleging lack of heat at a 90 Unit apartment complex in San Diego. The court determined that there was a complete failure of proof on several of the key elements of plaintiff’s case, based reference to CACI jury instructions and published California Case Law. The defense successfully argued that the Plaintiff failed to show a “material defect” that the building “substantially” lacked adequate heating. This was the first case of many the plaintiff’s counsel threatened to file for other tenants based on the same facts. The Defendants achieved a complete defense verdict allowing them to now pursue collection of their attorney’s fees and costs.
