A Lynberg & Watkins litigation team recently won summary judgment in federal court on behalf of the County of Orange in a $50 million dollar lawsuit filed by an Orange County Men’s Central Jail inmate who claimed that he was paralyzed from the waist down after an attack by other inmates.
The inmate claimed that the County violated his rights under the Fourteenth Amendment to the U.S. Constitution by failing to prevent the attack, arguments that were completely rejected by the court, which found that there was “insufficient evidence of the violation of [the inmate’s] constitutional rights” and ruled in favor of the County on all the inmate’s claims without any award of damages to the inmate.

In another recent victory, Lynberg & Watkins attorneys obtained complete dismissal of a lawsuit filed in federal court seeking more than $1 million dollars from a Southern California Police Department for alleged constitutional violations in connection with an arrest. In dismissing the lawsuit, the court determined that the Department had proven that the plaintiff had failed to diligently pursue his case, and he was therefore barred from continuing to litigate his claims. Despite the plaintiff’s attempt to file a second suit against the Department, the court again dismissed the case without any award to the plaintiff.
